The King Report on Corporate Governance (1994) evoked unprecedented interest in corporate governance in South Africa. This does not mean that corporate governance was not an issue of concern before the release of this historical report. To the contrary, corporate governance in its broader sense has been at stake since the inception of the first publicly owned companies in South Africa. This article intends to give an overview of corporate governance in South Africa. It starts by making a distinction between (...) broad and narrow conceptions of corporate governance. Before applying this distinction to the practice of corporate governance in South Africa, a brief overview of the corporate landscape in South Africa is provided. Then the South African situation with regard to broad and narrow corporate governance respectively is analysed. The article ends with a discussion of the review of corporate governance that currently is in the making in South Africa. Throughout the article both the financial and ethical dimensions of corporate governance is attended to. (shrink)

The dictum ‘“ought” implies “can”’ has a status in moral philosophy in some respects like that of ‘a good player needs good co-ordination’ in talk about ball-games. Clearly, you say something important but not conclusive about proficiency in playing a ball-game when you say that it requires good co-ordination: similarly, you say something important but not conclusive about obligation when you say that it implies a certain possibility or power or ability. Each dictum is a reminder: the one about such (...) courses of physical instruction, the other about such exhortations to duty, as are worth persevering with. It would be hopeless to keep on teaching a boy the moves and tricks of rugby football if he could never co-ordinate well enough to get his eye in, so to speak. Correspondingly, it would be meaningless to recommend that someone ought to do something the specification of which involved a contradiction, and pointless to suggest that he ought to do something which, for quite general reasons, was not, and was certain to remain not, within his power. So each dictum expresses a bluff, no-nonsense wisdom which we should count on before involving ourselves in certain more detailed commitments. But probably this is as far as the comparison between the two sayings can well be taken. (shrink)

More frequently in Plautus and Terence the heroine, if of respectable parentage, has been violated before the opening of the drama (Aulularia, Adelphoe), or she is a foreigner, a courtesan, or a slave girl' (Duckworth (1952), p. 158). Perhaps (...) in 1993 it does not seem quite so ‘modern’ that Charinus is not only in love with a respectable virgin but wishes to marry her. (shrink)

‘Menander has set up a confrontation between this law [the law about epikleroi] and love… He wants the audience to regard the law as stupid and wrong… Surely one of Menander's purposes in writing this play was to make the Athenians consider seriously whether the law ought to be changed.’ Thus Professor D. M. MacDowell in the concluding paragraph of his article ‘Love versus the Law: an Essay on Menander's Aspis’. A similar view was already implicit in E. Karabelias' treatment (...) of the play as indicative of the general attitude to this law in Athens in Menander's day: ‘A n'en point douter, l'épiclérat est ressenti, á l'epoque de Ménandre, comme une anomalie intolérable pour les mceurs de la societe athénienne à la fin du ive s.av.n.è L'épiclérat est odieux et ridicule… L'hostilité envers l'épiclérat est done un signe des temps’. The text of Euripides' Troades depends mainly upon the versions preserved in two manuscripts, viz. Palatinus 287 and Vaticanus 909 . Both these manuscripts are well known and have been several times collated. Their importance in relation to one another and to the other existing manuscripts for the study of the text of Euripides in general has been frequently discussed and is no longer a subject of major controversy. The notes which follow are designed to put on record a number (...) of corrections to the readings ascribed to P and V for the Troades in the apparatus criticus of Prinz-Wecklein and later editors; and to correct and amplify the general descriptions of P and to call attention to certain difficulties in the current views of its relationship to Laurentianus xxxii. In his article ‘Did the Athenians Regard Seduction as a Worse Crime than Rape?’, CQ 40 , 370–7, Edward M. Harris rightly casts doubt on the value of Lysias 1.30–5, which has generally been accepted as evidence that the Athenians did indeed regard seduction as the worse of the two crimes. Euphiletos in this speech is defending himself on a charge of murder, and, as Harris says , ‘Euphiletus’ presentation of the Athenian statutes regarding rape and seduction is dictated by (...) the rhetorical constraints of his case.
